DODGuidons.com is operated by 915 Synergy LLC, a Texas limited liability company ("DODGuidons," "DODGuidons.com," "we," "us," or "our").
Welcome to DODGuidons.com (the "Website"). These Terms and Conditions ("Terms") govern your access to and use of the Website and purchases of products and services from DODGuidons.com.
By accessing the Website, submitting an order, approving artwork, or purchasing products or services from us, you acknowledge that you have read, understood, and agree to these Terms.
If you do not agree to these Terms, please do not use the Website or place an order.
1. GOVERNMENT AND PUBLIC-SECTOR CUSTOMERS
When an order is placed pursuant to an authorized federal, state, local, or other governmental purchase order, contract, procurement agreement, government purchase card transaction, or other authorized procurement method, the applicable government contract or procurement terms will control to the extent they conflict with these Terms.
All provisions of these Terms that do not conflict with applicable government procurement requirements will remain in effect.
Specific written agreements, contracts, purchase orders, solicitations, or procurement requirements accepted by 915 Synergy LLC may supersede portions of these Terms.
2. USE OF THE WEBSITE
You must be at least 18 years old or the age of legal majority in your jurisdiction to make purchases through this Website.
You agree to use the Website only for lawful purposes and in accordance with applicable federal, state, and local laws and regulations.
You may not misuse the Website, interfere with its operation, attempt unauthorized access, introduce malicious software, or use the Website in connection with fraudulent or unlawful activities.
3. PRODUCTS, PRICING AND AVAILABILITY
All products and services are subject to availability.
We reserve the right to modify, discontinue, replace, or update products, materials, specifications, colors, designs, prices, or services without prior notice.
We make reasonable efforts to ensure that product descriptions, photographs, specifications, pricing, and other information are accurate. However, typographical, photographic, technical, or pricing errors may occasionally occur.
If an error affects an order, we reserve the right to correct the error and contact the customer before proceeding. If appropriate, we may cancel the affected order and issue a refund.
We also reserve the right to refuse or cancel an order when reasonably necessary, including suspected fraud, unauthorized trademark use, pricing errors, product unavailability, legal or regulatory concerns, or orders we are unable to manufacture.
4. CUSTOM AND PERSONALIZED PRODUCTS
Many products sold by DODGuidons.com are manufactured specifically for the customer and may include custom sizes, colors, lettering, embroidery, insignia, logos, artwork, engraving, printing, unit information, or other personalization.
Because these products are manufactured specifically for the customer, custom and personalized products are ordinarily non-cancelable, non-returnable, and non-refundable after production has begun, except where required by applicable law or expressly provided in these Terms.
Production may include, but is not limited to:
- Artwork preparation or digitizing
- Embroidery setup
- Material cutting
- Printing
- Sublimation
- Laser engraving
- Sewing
- Appliqué
- Embroidery
- Assembly
- Other manufacturing operations
If substantial design, digitizing, setup, or other custom work has already been completed before cancellation is requested, charges for work already performed may apply even if physical manufacturing has not yet begun.
5. ARTWORK, PROOFS AND CUSTOMER APPROVAL
When an artwork proof or digital representation is provided for approval, the customer is responsible for carefully reviewing all details before approving production.
This includes, but is not limited to spelling, names, numbers, dates, unit designations, lettering, colors, dimensions, orientation, logos, insignia, artwork, layout, and placement of design elements.
Approval by email, electronic communication, online approval system, or other written method constitutes authorization for DODGuidons.com to manufacture the product according to the approved design.
Once artwork has been approved, customer-requested changes may result in additional design, setup, material, or production charges and may extend the production schedule.
DODGuidons.com is not responsible for errors contained in artwork, specifications, wording, dimensions, colors, logos, or other information that the customer has reviewed and approved.
If we manufacture an item differently from the approved artwork or specifications because of our production error, we will evaluate the issue under our defective-product policy.
6. CUSTOMER DELAYS AND APPROVALS
Production schedules do not begin until all information necessary to manufacture the order has been received, including any required payment, artwork, logos or insignia, measurements, color selections, product specifications, customer approval, or documentation.
Any production estimate provided before receiving all required information is preliminary.
If customer approval, artwork, information, or clarification is delayed, the estimated production and delivery schedule may also be delayed.
Orders awaiting customer information or approval may be placed on hold until the required information is received.
7. CUSTOMER-SUPPLIED ARTWORK, LOGOS AND INTELLECTUAL PROPERTY
By submitting or requesting reproduction of any logo, trademark, service mark, seal, photograph, artwork, insignia, copyrighted design, company name, government identifier, school logo, military insignia, police/fire emblem, or other protected material, the customer represents that they are authorized to use and reproduce that material for the requested purpose.
The customer is responsible for obtaining any necessary permissions, licenses, authorizations, or approvals.
Submission of artwork to DODGuidons.com constitutes the customer's representation that reproduction of the material will not violate the intellectual-property or other legal rights of a third party.
915 Synergy LLC and DODGuidons.com are not responsible for determining ownership of customer-supplied intellectual property or independently verifying the customer's authority to reproduce it.
To the extent permitted by law, the customer agrees to indemnify and hold harmless 915 Synergy LLC and DODGuidons.com from third-party claims arising from the unauthorized reproduction or use of intellectual property supplied or requested by the customer.
We reserve the right to refuse to reproduce artwork when we reasonably believe its reproduction may violate applicable law, intellectual-property rights, government restrictions, or our policies.
8. MILITARY, GOVERNMENT AND ORGANIZATIONAL INSIGNIA DISCLAIMER
The appearance of names, seals, insignia, emblems, logos, trademarks, or other identifiers belonging to the U.S. Department of Defense, U.S. Armed Forces, federal agencies, state or local governments, law-enforcement agencies, fire departments, educational institutions, corporations, or other organizations does not constitute or imply endorsement, sponsorship, authorization, or affiliation with 915 Synergy LLC or DODGuidons.com.
All trademarks, service marks, logos, seals, and insignia remain the property of their respective owners.
Customers are responsible for determining whether the product they order complies with the regulations, policies, heraldic requirements, brand standards, uniform regulations, or other requirements of the organization they represent unless DODGuidons.com expressly agrees in writing to provide regulatory-compliance verification as part of the order.
Images displayed on the Website are examples of products we manufacture and do not constitute approval of those designs by any government agency, military branch, corporation, school, or other organization.
9. COLORS, MATERIALS AND MANUFACTURING VARIATIONS
Custom textile, embroidered, printed, sewn, engraved, and manufactured products may contain minor variations inherent in the manufacturing process.
Computer monitors, mobile devices, photographs, and digital proofs may display colors differently from physical materials.
Thread, fabric, ink, sublimation, vinyl, metal, wood, acrylic, and other materials may also vary slightly between manufacturers, production lots, and manufacturing processes.
Reasonable variations in color, dimensions, stitching, placement, texture, material shade, engraving, printing, or other characteristics that do not materially affect the intended use of the product are not considered manufacturing defects.
10. PAYMENT AND BILLING
Unless otherwise agreed in writing, payment is due in full before production begins.
Government and approved institutional customers may be subject to separate payment arrangements established through an accepted purchase order, contract, procurement system, or written agreement.
Customers are responsible for providing accurate billing, shipping, contact, and payment information.
Incorrect or incomplete information may result in production or shipping delays.
11. ORDER CHANGES AND CANCELLATIONS
Requests to change or cancel an order should be submitted as soon as possible.
For standard, non-custom products, cancellation may be possible if the order has not entered processing or shipment.
For custom products:
Before custom work begins: Cancellation may be permitted.
After design, artwork, digitizing, or setup work begins: Charges may apply for work already completed.
After artwork approval or production begins: The order is ordinarily non-cancelable and non-refundable.
After completion: Custom products cannot ordinarily be canceled or returned because the customer changed their mind.
Nothing in this section limits rights available to customers under applicable law.
12. PRODUCTION TIMES
Production time refers to the time required to manufacture an order and is separate from carrier transit time.
Unless expressly guaranteed in writing, production times displayed on the Website, provided by email, shown on quotes, or otherwise communicated are estimates.
Production times may be affected by order complexity, order volume, material availability, customer approval delays, equipment issues, staffing, supply-chain interruptions, or other circumstances.
Where applicable, we will comply with federal and state requirements concerning shipping delays, customer notification, cancellation rights, and refunds.
13. RUSH ORDERS, CEREMONIES AND IN-HAND DATES
Customers ordering products for ceremonies, graduations, changes of command, retirements, deployments, presentations, military events, conferences, or other date-sensitive events should provide their required in-hand date when placing the order.
Providing an event or in-hand date does not automatically constitute a guaranteed delivery commitment.
A required delivery date is guaranteed only when expressly accepted by DODGuidons.com in writing as a guaranteed commitment.
Rush-production charges, when applicable, relate to manufacturing priority and do not automatically include expedited shipping.
Similarly, purchasing expedited carrier service does not automatically expedite manufacturing.
14. SHIPPING AND DELIVERY
Shipping charges and available shipping methods are displayed at checkout or provided as part of a quote.
Production time and shipping/transit time are separate.
Once an order has shipped, carrier delivery estimates are generally outside our direct control.
We are not responsible for carrier delays caused by weather, transportation disruptions, incorrect addresses supplied by the customer, customs processing, government actions, natural disasters, or other circumstances outside our reasonable control, subject to applicable law.
Customers are responsible for providing a complete and accurate shipping address.
Additional shipping charges resulting from an incorrect or incomplete customer-supplied address, refused shipment, or returned package may be the customer's responsibility.
15. LOST, DAMAGED OR MISDELIVERED PACKAGES
Customers should notify DODGuidons.com promptly if a package arrives damaged, appears to be lost in transit, contains damaged merchandise, is shown as delivered but cannot be located, or is returned to sender.
We may request photographs, packaging, tracking information, carrier documentation, or other information necessary to investigate the claim.
Customers agree to reasonably cooperate with carrier investigations and insurance claims.
A carrier's "Delivered" tracking status may require investigation before a replacement or refund determination can be made.
Claims will be evaluated based on the circumstances of the shipment, carrier information, applicable insurance coverage, and applicable law.
16. RETURNS, DEFECTS, REMAKES AND REFUNDS
Customers should inspect merchandise promptly upon receipt.
Claims involving manufacturing defects, incorrect merchandise, shortages, shipping damage, or DODGuidons production errors must be reported within 20 calendar days of delivery.
Customers may be asked to provide an order number, description of the issue, photographs of the product, photographs of packaging, or other information reasonably necessary to evaluate the claim.
Custom products are not returnable merely because the customer changes their mind, ordered an incorrect size, provided incorrect information, or approved artwork containing an error.
If DODGuidons.com confirms that a product contains a manufacturing defect or production error for which we are responsible, we may, as appropriate and subject to applicable law, repair or correct the product, replace or remanufacture the product, or issue a partial or full refund.
The appropriate remedy will depend upon the nature and severity of the issue.
Nothing in this section limits any rights or remedies available under applicable law.
17. REFUND PROCESSING
Approved refunds are returned using the original payment method whenever reasonably possible.
After a refund is processed by DODGuidons.com, banks and credit-card companies may require additional processing time before the credit appears on the customer's account.
If an approved refund does not appear after a reasonable processing period, customers should first contact their bank or card issuer and may then contact us for assistance.
18. PAYMENT DISPUTES AND CHARGEBACKS
If a customer believes there is an error involving an order, payment, product, or shipment, we encourage the customer to contact DODGuidons.com before initiating a payment dispute or chargeback so that we have an opportunity to investigate and attempt to resolve the matter.
Nothing in these Terms waives any rights a customer may have under applicable credit-card, banking, or consumer-protection laws.
19. WEBSITE INTELLECTUAL PROPERTY
Except for third-party intellectual property identified elsewhere in these Terms, the Website and its original content—including text, photographs, graphics, product descriptions, layouts, designs, and other materials—are owned by or licensed to 915 Synergy LLC and are protected by applicable intellectual-property laws.
No Website content may be copied, reproduced, republished, distributed, or commercially exploited without prior written authorization except as permitted by applicable law.
20. DISCLAIMER OF WARRANTIES
To the maximum extent permitted by applicable law, the Website and products and services are provided subject to the warranties, representations, and remedies expressly stated in these Terms.
We do not guarantee that the Website will operate continuously, without interruption, or without technical errors.
Nothing in these Terms excludes or limits warranties or consumer rights that cannot legally be excluded or limited.
21. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, 915 Synergy LLC, DODGuidons.com, and their owners, officers, employees, agents, and representatives will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use of the Website or the purchase or use of products or services.
To the maximum extent permitted by law, our total liability arising from a particular product or service will not exceed the amount actually paid to us for that product or service.
These limitations do not apply where prohibited by law.
22. INDEMNIFICATION
To the extent permitted by applicable law, users and customers agree to indemnify and hold harmless 915 Synergy LLC, DODGuidons.com, and their owners, officers, employees, and agents from third-party claims, damages, liabilities, and reasonable costs arising from unlawful use of the Website, violation of these Terms, customer-supplied artwork or intellectual property, unauthorized use of protected content, or fraudulent or unlawful activity by the customer.
23. FORCE MAJEURE
DODGuidons.com will not be responsible for delays or failures caused by circumstances beyond our reasonable control, including severe weather, natural disasters, fire, flood, power outages, Internet or telecommunications outages, carrier disruptions, supply-chain interruptions, material shortages, labor disruptions, equipment failures, government actions, war or civil emergencies, public-health emergencies, or other comparable events beyond our reasonable control.
We will make reasonable efforts to resume affected operations as circumstances permit.
Nothing in this section eliminates customer cancellation, refund, or other rights required by applicable law.
24. PRIVACY AND COOKIES
Our collection and use of personal information is governed by our Privacy Policy.
The Website may use cookies and similar technologies necessary for website operation, shopping-cart functionality, security, analytics, and other permitted purposes.

25. GOVERNING LAW AND VENUE
Except where applicable law requires otherwise, these Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
To the extent permitted by applicable law, legal proceedings arising from these Terms or transactions with 915 Synergy LLC shall be brought in a court of competent jurisdiction located in El Paso County, Texas.
26. SEVERABILITY
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect to the extent permitted by law.
27. NO WAIVER
Failure by 915 Synergy LLC or DODGuidons.com to enforce any provision of these Terms on one occasion does not constitute a waiver of our right to enforce that provision or any other provision in the future.
28. ENTIRE AGREEMENT AND ORDER OF PRECEDENCE
These Terms, together with applicable quotes, invoices, purchase orders, approved artwork, product-specific terms, written agreements, and policies incorporated by reference, constitute the agreement applicable to the transaction.
If conflicting terms exist, the following order of precedence will generally apply, subject to applicable law:
- An expressly accepted written contract or government procurement agreement;
- An expressly accepted purchase order or written quote;
- Customer-approved artwork and product specifications;
- Product-specific written terms;
- These Website Terms and Conditions.
No verbal statement will modify an expressly agreed written specification or contract unless confirmed in writing by an authorized representative of 915 Synergy LLC.
29. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes in our business practices, Website, products, or applicable requirements.
Changes become effective when posted to the Website unless otherwise stated.
The Terms applicable to a transaction will generally be those in effect when the customer places the order, except where subsequent changes are required by law or mutually agreed in writing.
